6-month delay in the entry into force of Regulation 947 of RPAS in the European Union

It is official.

The European Commission publishes today June 5 in the Official Gazette Implementing Regulation 746, which modifies the date of entry into force of Implementing Regulation 947 in 6 months.

As indicated in the aforementioned new regulation, which modifies the date of entry into force by stages of Implementing Regulation 947, the new date of entry is December 31, 2020.

The published regulation itself indicates that there have been delays in the standardization process and other related activities carried out by the sector and standardization bodies, such as the preparation of test methodologies or the testing of technical characteristics, such as identification of distance. This, in turn, will negatively impact the ability of manufacturers to introduce unmanned aircraft systems ('UAS') to the market that meet the new standard requirements set out in Delegated Regulation (EU) 2019/945.

Therefore, all types of UAS must be able to continue operating under current conditions for an additional six months. Accordingly, the dates of application of Implementing Regulation (EU) 2019/947 should be deferred accordingly, so that UAS operators can use those aircraft without complying with the provisions of Delegated Regulation (EU) 2019/945 for six additional months.
